Requirements For Receiving Your Former Spouse's Social Security Benefits

February 08, 2024

If you are divorced you may be able to receive Social Security from your former spouse’s income.  My name is Brenda Rolli, AAMS with Provident Financial Consultants. Today I’m going to share the five qualifications that must be met to receive Social Security benefits from your former spouse:

  1. You were married to your ex-spouse for at least 10 years
  2. You are currently unmarried
  3. You are at least 62 years old
  4. You have a former spouse is eligible to claim Social Security or disability benefits
  5. You have personal Social Security benefits available to you that are less than what you would receive from your former spouse.

These benefits apply even if your former spouse remarried. Additional conditions can affect these benefits, so consult with your professional advisors on your specific situation.
